Statement: Brnovich Enforcement of Pre-Statehood Ban

PHOENIX, AZ – Today, Attorney General Mark Brnovich announced that the pre-statehood law on abortion in Arizona, which bans abortion in all cases, except when the health of the pregnant person is in danger, is now the current law in Arizona.

ADLCC Board Chair and Assistant House Leader Representative Jennifer Longdon released the following statement:

“Attorney General Mark Brnovich and his interpretation of the law takes Arizona more than 120 years backward to our pre-statehood territorial days of 1901 when the law was enacted,” said Assistant House Leader and ADLCC Board Chair, Representative Jennifer Longdon. “The idea that we would enforce a pre-statehood law which hasn't been considered by The State of Arizona is astounding. It means that Arizona voices have been silenced on this issue.”

“The fight to protect reproductive freedoms and access to abortion will take place in state legislatures across this country—and right here in Arizona’s state government. It’s imperative that we protect the rights of Arizonans today and of future generations. That’s what we’re working toward every day at the ADLCC.”
